Appeals To The Supreme Court
An appeal lies to the Supreme Court:
- from any decree or final order passed on appeal by a I High Court or by any other court of final appellate jurisdiction;
- from any decree or final order passed by a High Court in the exercise of original civil jurisdiction; and
- from any decree or final order, when the case is certified as appropriate for appeal to the Supreme Court.
Provided that in each of the cases mentioned in clauses (i) and (ii) the following two conditions are satisfied, namely:
- the amount or value of the subject maller of the suit in the court of first instance and of the subject matter in dispute on appeal to the Supreme Court is Rs. 20,000 or upwards or the decree or final order involves some claim or question to or property of the amount or value of Rs. 20,000 or upwards; and
- where the decree or final order appealed from affirms the decision of the court immediately below the court passing such decree or order, the appeal involves some substantial question of law.
- from any decree or final order, when the case is certified as appropriate for appeal to the Supreme Court.
